Compliance Review

Recommendation by the Director CRMU for a Compliance Review

Within 30 days after determining the eligibility for a Compliance Review, the CRMU director shall submit a Report to the Boards of Directors or the President (depending on the status of the project) with recommendation to authorize or not to authorize a Compliance Review.

If a compliance Review is recommended, the Report shall include:

  • Draft terms of reference for the Compliance Review Panel,
  • Proposal of two experts from the Roster of Experts to the Review Panel (one shall be the chairperson of the Panel),
  • Budget and other resources as required for the Compliance Review.

In case the CRMU director decides not to recommend a Compliance Review, the Chairperson of the Roster of Experts shall be asked to review the Request, and to include in a separate report his or her independent recommendation.

The Boards of Directors or the President (depending on the status of the project) shall, on a no objection basis, authorize the Compliance Review.

The Compliance Review Panels shall comprise two Experts from the Roster and the CRMU director. The CRMU director participates in all aspects of the compliance review undertaken by a Panel, but shall have a vote in a decision only in the event of a deadlock between the Experts.

The Compliance Review Panel shall conduct the Compliance Review in accordance with the authorized terms of reference and time frame. The Compliance Review Panel may:

  • Solicit additional oral or written information from, or hold meetings with, the requestors and any interested party,
  • Undertake site visits to the project(s) in issue,
  • Retain additional expertise to assist with an inquiry, assessment, review or exercise.

Upon completion of its investigations, the Compliance Review Panel shall within 30 days write and submit a Report to the Boards of Directors or the President (depending on the status of the project) including its findings and recommendations for:

  • Any remedial change in the scope or implementation of the Bank financed project,
  • Any remedial change to systems or procedures within the Bank to avoid a recurrence of such or similar violations,
  • Any steps to be taken to monitor the implementation of the changes referred to above.

The Report’s recommendations shall be decided upon by the Boards of Directors or the President (depending on the status of the project).
